Welcome to The Rare Remix, operated by Rare Remix Media LLC, an Indiana limited liability company. These Terms of Use (“Terms”) govern your access to and use of our website, podcast, articles, resources, downloads, newsletters, emails, social media content, shop, products, forms, submissions, and related services (collectively, the “Site” or “Services”).

By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Purpose of The Rare Remix

The Rare Remix exists to share stories, resources, education, interviews, lived experience, and community support for families navigating rare disease, disability, caregiving, advocacy, accessibility, family life, and related topics.

The Site is intended for informational, educational, editorial, storytelling, and community-resource purposes only. Nothing on the Site should be treated as individualized professional advice.

2. No Medical Advice or Emergency Services

The Rare Remix does not provide medical advice, diagnosis, treatment, emergency response, therapy, clinical services, or patient care.

Content shared through articles, podcast episodes, interviews, downloads, emails, social media, products, resources, or other materials is provided for general informational and educational purposes only. Always seek the advice of qualified healthcare professionals regarding any medical condition, diagnosis, therapy, medication, equipment, treatment decision, safety issue, or emergency concern.

Never disregard professional medical advice, delay seeking medical care, or change a treatment plan because of something you read, hear, or view through The Rare Remix.

3. No Legal, Financial, Tax, Educational, or Professional Advice

The Site may discuss topics such as Medicaid, waivers, benefits, insurance, estate planning, special needs trusts, guardianship, school supports, IEPs, education rights, assistive technology, family finances, caregiving systems, or advocacy.

This information is provided for general educational purposes only and should not be relied upon as legal, financial, tax, educational, therapeutic, insurance, benefits, or other professional advice. Laws, programs, benefits, eligibility rules, and procedures vary by jurisdiction and may change over time.

You are responsible for consulting qualified professionals regarding your specific circumstances.

4. Health Information and HIPAA Boundary

The Rare Remix is a media, education, storytelling, and resource platform. Rare Remix Media LLC is not a healthcare provider, health plan, healthcare clearinghouse, medical record custodian, insurer, therapist, school, government agency, or emergency service.

Information you voluntarily submit to us may include health, disability, caregiving, family, education, or other sensitive personal information. By voluntarily submitting that information to us, you understand that it may not be protected by HIPAA in the same way as information held by your healthcare provider, insurer, clinic, hospital, therapist, or other covered entity.

These Terms do not authorize any healthcare provider, insurer, clinic, therapist, hospital, school, agency, or other third party to disclose records or protected information to us. If records are ever needed directly from a healthcare provider, insurer, or other covered entity, a separate authorization may be required.

5. Personal Responsibility

By using the Site, you acknowledge that you are responsible for your own decisions, actions, and outcomes.

You agree to use your own judgment, verify information, conduct your own research, and consult appropriate professionals before acting on any information obtained through The Rare Remix.

6. Intellectual Property

Unless otherwise noted, all content on the Site is owned by Rare Remix Media LLC or used with permission. This includes, without limitation:

The Site and its content are protected by copyright, trademark, and other intellectual-property laws.

You may view Site content for personal, non-commercial use and share links to publicly available content.

You may not, without our prior written permission:

  • Copy, reproduce, republish, upload, distribute, sell, license, or modify Site content

  • Use Site content for commercial purposes

  • Use our name, logo, branding, artwork, podcast name, show name, or merchandise designs

  • Remove copyright, trademark, or proprietary notices

  • Scrape, data mine, crawl, or systematically copy Site content

  • Use Site content to train artificial intelligence systems, machine-learning models, or automated tools

  • Present Site content as your own

  • Use Site content in a way that suggests sponsorship, endorsement, partnership, or affiliation without written permission

All rights not expressly granted are reserved.

7. User Contributions and Submissions

You may have opportunities to submit comments, questions, stories, reviews, testimonials, feedback, guest inquiries, sponsorship inquiries, media inquiries, photos, videos, documents, or other content to The Rare Remix (“User Contributions”).

By submitting User Contributions, you grant Rare Remix Media LLC a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, edit, publish, display, distribute, adapt, excerpt, archive, and otherwise use your User Contributions in connection with our mission, operations, content, promotion, business activities, and Services.

You represent and warrant that:

  • You own the User Contributions or have all rights, licenses, permissions, and consents necessary to submit them.

  • Your submission does not violate any copyright, trademark, privacy right, publicity right, confidentiality obligation, court order, custody order, contract, or other third-party right.

  • Your submission is not knowingly false, defamatory, misleading, unlawful, abusive, harassing, obscene, threatening, or otherwise inappropriate.

  • You have legal authority to submit any personal information, images, stories, recordings, documents, or sensitive details about another person.

  • You will not submit medical records, school records, therapy records, legal documents, private communications, photographs, videos, or other materials involving another person unless you have the legal right to do so.

We may remove, edit, decline, or refuse to publish User Contributions at our discretion.

8. Separate Media Releases and Contributor Agreements

Certain participation in The Rare Remix may require a separate written release, contributor agreement, appearance agreement, guest agreement, sponsor agreement, or other written consent.

This may include, without limitation:

  • Podcast interviews

  • Video appearances

  • Guest articles

  • Submitted family stories

  • Photographs or recordings

  • Testimonials

  • Contributor submissions

  • Sponsored content

  • Content involving children, dependents, protected persons, health information, disability, education, caregiving, family life, or other sensitive personal information

If these Terms conflict with a separately signed agreement between you and Rare Remix Media LLC, the separately signed agreement controls with respect to the applicable content, participation, submission, project, sponsorship, or deliverable.

9. Minors, Dependents, and Protected Persons

The Site is intended for use by adults. Minors should use the Site only with involvement and permission from a parent or legal guardian.

You may not submit content, stories, photos, videos, recordings, documents, personal information, health information, school information, or other sensitive information about a minor, adult dependent, protected person, or another individual unless you have the legal right and authority to do so.

We may require parent, guardian, conservator, or authorized-representative consent before accepting, publishing, recording, or using content involving a minor, dependent, protected person, or sensitive family circumstances.

10. Community Standards

You agree not to use the Site to:

  • Violate any law or regulation

  • Infringe the rights of others

  • Submit false, defamatory, private, confidential, or unlawfully obtained information

  • Harass, threaten, abuse, exploit, or harm others

  • Submit spam, malware, bots, or harmful code

  • Interfere with the operation, security, or availability of the Site

  • Impersonate another person or misrepresent your identity or affiliation

  • Use the Site for unauthorized commercial, political, fundraising, or solicitation purposes

  • Collect information about other users without permission

We reserve the right to restrict access, remove submissions, block users, or take other action if we believe these Terms or our community values have been violated.

The Site may include links or references to third-party websites, products, services, providers, organizations, books, tools, resources, events, platforms, or materials.

We are not responsible for the content, policies, privacy practices, availability, safety, accuracy, quality, or reliability of any third-party site, product, service, or resource. Inclusion of a link or reference does not necessarily constitute endorsement, sponsorship, partnership, or approval.

You access third-party resources at your own risk.

12. Affiliate Links, Sponsored Content, and Recommendations

From time to time, The Rare Remix may recommend products, services, books, tools, organizations, events, or resources that we believe may be helpful to our audience.

Some links or recommendations may be affiliate links, sponsored placements, paid partnerships, gifted products, or other relationships for which we may receive compensation, commissions, discounts, products, services, or other value. We will aim to disclose material relationships where required or appropriate.

We strive to share recommendations we believe may provide value, but you are responsible for evaluating whether any product, service, provider, organization, or resource is appropriate for your circumstances.

13. Shop, Merchandise, and Products

The Rare Remix may offer merchandise or products, including clothing, gear, accessories, printed materials, digital downloads, or other items.

Product images, colors, descriptions, sizing, availability, shipping times, and pricing may vary and may be changed at any time. Some products may be produced, fulfilled, shipped, or processed by third-party providers, vendors, platforms, or payment processors.

Unless expressly stated otherwise, products sold through The Rare Remix are not medical devices, adaptive equipment, therapeutic products, safety devices, clinical tools, or substitutes for professional guidance.

We are not responsible for delays, errors, acts, omissions, policies, or performance of third-party vendors, fulfillment providers, shipping carriers, payment processors, or ecommerce platforms, except to the extent required by applicable law.

Returns, refunds, exchanges, cancellations, shipping, and order issues may be subject to separate shop policies or third-party provider policies.

14. Guest, Sponsor, Partner, and Media Inquiries

The Site may allow you to submit guest, sponsor, partner, collaboration, media, speaking, press, or general inquiries.

Submitting an inquiry does not create a partnership, sponsorship, agency relationship, joint venture, employment relationship, confidentiality obligation, endorsement, approval, obligation to respond, obligation to publish, or obligation to enter into any agreement.

Any sponsorship, partnership, guest appearance, media appearance, contributor relationship, or client-directed project must be documented in a separate written agreement if required by Rare Remix Media LLC.

Do not submit confidential, proprietary, privileged, or sensitive business information unless a separate written agreement is in place.

15. Corrections, Removal Requests, and Third-Party Distribution

We may consider correction, removal, or limitation requests in good faith, especially where content involves sensitive family, health, disability, caregiving, education, or safety concerns.

However, we cannot guarantee that content will be corrected, removed, limited, or deleted. Once content is published, distributed, indexed, cached, archived, embedded, reposted, downloaded, quoted, shared, or otherwise controlled by third parties, full removal may not be possible.

Nothing in this section limits any separate rights or obligations stated in a signed media release, contributor agreement, sponsorship agreement, or other written agreement.

16. Privacy

Your use of the Site is also governed by our Privacy Policy. By using the Site, you acknowledge that information may be collected, used, stored, shared, and processed as described in that policy.

If there is a conflict between these Terms and our Privacy Policy regarding privacy practices, the Privacy Policy controls for that issue.

17. Emails and Newsletters

If you sign up for our newsletter, updates, downloads, forms, or other communications, you agree that we may send you emails or other messages related to The Rare Remix.

You may unsubscribe from marketing emails using the unsubscribe link or instructions provided in those emails. We may still send administrative, transactional, legal, or service-related messages where appropriate.

18. Disclaimer of Warranties

The Site and all content, products, resources, and services are provided “as is” and “as available” without warranties of any kind, express or implied.

To the fullest extent permitted by law, Rare Remix Media LLC disclaims all warranties, including warranties of accuracy, completeness, reliability, availability, merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

We do not guarantee that:

  • The Site will always be available, secure, or error-free

  • Content will be accurate, complete, current, or suitable for your circumstances

  • Products, resources, or recommendations will meet your needs

  • Third-party links, vendors, platforms, or services will perform as expected

  • Any outcome, benefit, or result will occur from using the Site

Your use of the Site is at your own risk.

19. Limitation of Liability

To the fullest extent permitted by law, Rare Remix Media LLC, The Rare Remix, and their owners, officers, managers, members, employees, contractors, contributors, guests, affiliates, partners, sponsors, representatives, agents, service providers, successors, and assigns shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or other damages arising out of or relating to:

  • Use of the Site

  • Reliance on Site content

  • Inability to access or use the Site

  • User Contributions

  • Third-party links, products, platforms, services, vendors, or resources

  • Product orders, fulfillment, shipping, returns, or ecommerce issues

  • Unauthorized access, technical issues, interruptions, or data loss

  • Decisions, actions, or outcomes based on content from The Rare Remix

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, liability is limited to the fullest extent permitted by law.

20. Indemnification

You agree to indemnify, defend, and hold harmless Rare Remix Media LLC, The Rare Remix, and their owners, officers, managers, members, employees, contractors, contributors, guests, affiliates, partners, sponsors, representatives, agents, service providers, successors, and assigns from and against any claims, demands, liabilities, damages, losses, costs, expenses, and reasonable attorneys’ fees arising out of or relating to:

  • Your use of the Site

  • Your violation of these Terms

  • Your User Contributions

  • Your violation of any law or regulation

  • Your violation of another person’s rights

  • Your submission of content, materials, documents, images, recordings, or information without required rights or permissions

  • Your misuse of Site content, branding, products, or resources

21. Changes to the Site and These Terms

We may modify, suspend, discontinue, or update any part of the Site at any time.

We may also update these Terms at any time by posting revised Terms on the Site. Changes become effective when posted unless otherwise stated. Your continued use of the Site after revised Terms are posted means you accept the revised Terms.

22. Governing Law and Venue

These Terms are governed by and interpreted in accordance with the laws of the State of Indiana, without regard to conflict-of-law principles.

To the fullest extent permitted by law, any dispute arising out of or relating to these Terms, the Site, or your use of the Site may be brought in the state courts located in Marion County, Indiana, or the federal court for the Southern District of Indiana, and you consent to personal jurisdiction and venue in those courts.

23. Electronic Communications and Signatures

You consent to receive communications from us electronically, including by email, website posting, form submission, or other electronic means.

Where a written agreement, acknowledgment, consent, or signature is required, electronic records and electronic signatures may be used and will be treated as valid to the fullest extent permitted by law.

24. Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable, if permitted by law.

25. Entire Agreement

These Terms, together with our Privacy Policy and any other written policies or agreements that expressly apply, constitute the entire agreement between you and Rare Remix Media LLC regarding your use of the Site.

Any separately signed agreement, including a media release, contributor agreement, sponsor agreement, guest agreement, or client agreement, controls over these Terms for the specific content, participation, project, deliverable, or relationship covered by that agreement.
